How the property market works in Sweden

In Sweden, estate agents (fastighetsmäklare) must be registered with the Fastighetsmäklarinspektionen (FMI), the Swedish real estate agents' inspectorate, which requires relevant education and ongoing compliance with the Estate Agents Act.

A distinctive feature of the Swedish market is the widespread use of open bidding processes (budgivning) managed by the listing agent, who is legally required to act impartially between buyer and seller despite being engaged by the seller.

Buying and selling: key steps

The transfer of ownership is documented in a köpebrev (bill of sale) following an initial köpekontrakt (purchase contract), and the new owner applies for registration (lagfart) with Lantmäteriet, the Swedish mapping, cadastral and land registration authority.

Buyers pay a stamp duty (stämpelskatt) when registering lagfart, calculated on the purchase price, alongside a registration fee; mortgage registration (pantbrev) incurs a separate fee.

Working with agents, managers and architects

Agent commission (mäklararvode) in Sweden is freely negotiated with the seller, who engages and pays the agent, commonly structured as a percentage of the sale price or a fixed fee, with terms set out in a written agency agreement (uppdragsavtal).

Architects are not subject to a single protected licensing title in the way some professions are, though many belong to the Swedish Association of Architects (Sveriges Arkitekter), and building permits (bygglov) are issued by the local municipality.

Things to check before hiring

Check an agent's registration status on the FMI public register and confirm they carry the mandatory professional indemnity insurance.

Review the mandatory pre-sale disclosure documents, including any independent building survey (besiktning) commissioned by the seller, and check the bostadsrätt (tenant-ownership association) accounts for apartments before bidding.
