In Brazil, real estate agents (corretores de imóveis) must be licensed by the Conselho Regional de Corretores de Imóveis (CRECI) in their state, under rules set by the federal council COFECI.
Property management and condominium administration (administração de condomínios) are often handled by specialised firms, which are important given the prevalence of apartment living with condominium associations in Brazilian cities.
Buying and selling: key steps
A notary office (cartório de notas) formalises the deed of sale (escritura pública) for cash transactions, and the transfer is then registered at the cartório de registro de imóveis (real estate registry office) covering the property, which is the step that legally transfers ownership in Brazil.
Buyers pay ITBI (Imposto de Transmissão de Bens Imóveis), a municipal transfer tax whose rate is set by each city, along with registry and notary fees.
Working with agents, managers and architects
Agent commission in Brazil is commonly charged as a percentage of the sale price, conventionally paid by the seller, though CRECI-recommended tables and local practice vary by state and remain subject to negotiation.
Architects must be registered with the Conselho de Arquitetura e Urbanismo (CAU), and civil engineers with CREA, and projects above certain sizes require municipal approval before construction.
Things to check before hiring
Check an agent's CRECI registration number, which by law must appear on advertising and contracts, before engaging their services.
Request a certidão de matrícula atualizada from the cartório de registro de imóveis to confirm current ownership and any liens, and check for outstanding condominium fees or property tax (IPTU) debts before signing a purchase agreement.
